Providing the above personal data is voluntary. However, without providing some data (especially identification and contact information), we may not be able to provide you with the requested service (e.g. registering for a course or sending a newsletter).
Purposes and legal bases of processing
We process your personal data only to the extent necessary and for clearly defined purposes . For each purpose, we assign the corresponding legal basis for processing pursuant to Article 6 GDPR. Specifically, your data may be processed for the following purposes:
- Service provision and contractual agenda : If you order or register for a service from us (e.g. swimming course, one-time entry, etc.), we need your data to fulfill the contract or take measures prior to concluding the contract. The legal basis is the fulfillment of the contract pursuant to Article 6(1)(b) GDPR.
- Communication and processing of your requests : If you contact us with a question, inquiry or request (by phone, email or via a form), we will use your contact and identification data to respond or process it. The legal basis is either the performance of the contract or our legitimate interest in answering your question (Article 6(1)(f) GDPR).
- Marketing – sending newsletters and commercial communications : If you have subscribed to our newsletter, we will process your e-mail address (or name) for the purpose of sending regular news, information about events and other commercial communications relating to Aquacentrum Teplice. The legal basis is your consent to the processing of personal data pursuant to Article 6(1)(a) of the GDPR. If you are our existing customer, we may send you commercial communications relating to our own similar services without your prior consent on the basis of our legitimate interest (Article 6(1)(f) of the GDPR and Section 7(3) of Act No. 480/2004 Coll.).
- Website operation and service improvement : When you visit our website, certain technical data (e.g. IP address, cookies) is automatically processed. We process this data to ensure the correct loading and functioning of the website, to analyze traffic and, if necessary, to personalize content or advertising. The legal basis is either our legitimate interest in operating the website or your consent (for optional cookies).
Newsletter and sending commercial communications
Registration for subscription: You can register to receive our newsletter via the form on our website. When registering, we usually only require an e-mail address (or a name for a more personal address). When registering, we ask you for your consent to the processing of personal data for the purpose of sending commercial communications - without this consent, we cannot subscribe you to the newsletter.
Purpose and content of the newsletter: Through the newsletter, we want to inform you about news, planned events, offered services and other updates related to Aquacentre Teplice. We will not send you any third-party communications unrelated to our own services without your express consent. All messages from us will be clearly marked as commercial communications and will contain information about the sender. Each e-mail also contains a functional unsubscribe link so that you can easily cancel your consent or refuse further sending at any time.
Sending period: We will store and use your data for the newsletter for the duration of your consent, i.e. until you unsubscribe (or until you object to further sending in the case of existing customers). After you unsubscribe, we will no longer use your contact data for this purpose; we will delete it from the newsletter database no later than 1 year after unsubscribe for documentation purposes.
Unsubscribe option: You can unsubscribe from the newsletter at any time by clicking on the "Unsubscribe" link in the footer of each newsletter email or by sending an email to our contact email. Unsubscribing is free and easy, without any conditions - we will not delay you by filling in the reasons for unsubscribing. After unsubscribing, you will no longer receive any commercial offers or newsletters.
Data retention period
We only retain personal data for as long as is strictly necessary for the purposes for which it is processed or as required by law. The retention period varies depending on the purpose:
- Data processed for the purpose of providing services (contractual relationship) – we store it for the duration of the contract and then for up to 10 years after its termination (e.g. due to limitation periods and archiving of invoices).
- Data that we must retain by law (e.g. accounting documents) – according to relevant regulations (e.g. 5 years for accounting documents, 10 years for tax documents, etc.).
- Data from regular communication – we keep it as standard for the duration of the communication. Once the request is processed and there are no further claims, we delete the data unless there is another reason for further processing.
- Newsletter (marketing) – we store your data for sending for the duration of your consent. After you unsubscribe, we no longer use your data for this purpose; we will delete it from the database no later than 1 year after you unsubscribe (see above).
- Cookies and online identifiers - the retention period varies depending on the specific cookie and is specified in the cookie settings on the website (e.g. short-term session cookies are deleted when the session ends, permanent cookies according to the set lifetime).
After the specified retention periods have expired, we securely delete or anonymize personal data so that it is no longer associated with a specific person.
Your rights as a data subject
In accordance with the GDPR, you as a data subject have the following rights, which you can exercise at any time. You can exercise your rights by contacting the controller (see contact details below). We will respond to your requests without undue delay, but no later than 1 month from receipt of the request (in exceptional cases, we may extend the period by another 2 months, of which we will inform you). Exercising your rights is free of charge; if the requests are manifestly unfounded or excessive, we may charge you an administrative fee or refuse the request.
Your main rights include:
- Right to access data – you can request confirmation as to whether we are processing your personal data and, if so, you have the right to obtain a copy of that data and information about how it is processed.
- Right to correction – if you find that we are recording outdated or inaccurate data, you have the right to request its correction or completion.
- Right to erasure – in certain circumstances you can request that we erase your personal data (e.g. if the data is no longer necessary for the purposes for which it was processed or you withdraw your consent). Please note that the right to erasure is not absolute – we cannot erase data that we are required to process by law or to protect our legal claims.
- Right to restriction of processing – in certain situations, you have the right to request that we temporarily restrict the processing of your personal data (e.g. if you dispute the accuracy of the data or object to the processing). Restriction means that the data will only be stored and will not be otherwise processed until the reason for the restriction has ceased to exist.
- Right to data portability – if the processing is based on consent or a contract and is carried out by automated means, you have the right to receive the data you have provided to us in a structured, commonly used and machine-readable format and, where appropriate, to transmit it to another controller.
- Right to object – if we process your data on the basis of legitimate interest, you have the right to object to such processing at any time. In the event of an objection to the sending of commercial communications (marketing), we will immediately terminate the processing for this purpose.
- Right to withdraw consent – if the processing is based on your consent (e.g. sending a newsletter, using optional cookies), you have the right to withdraw your consent at any time. The withdrawal does not have retroactive effect – the processing was valid until now – but it means that from the moment of withdrawal we may no longer use the data for the given purpose.
- The right to file a complaint with a supervisory authority – if you believe that we are processing your personal data in violation of legal regulations, you have the right to file a complaint with the supervisory authority, which in the Czech Republic is the Office for Personal Data Protection (ÚOOÚ), with its registered office at Pplk. Sochora 27, 170 00 Prague 7.
Please note that some of the above rights may be mutually exclusive in certain situations (e.g. the right to erasure may not apply to data necessary for compliance with a legal obligation). However, we will always inform you in response to your request what steps we have taken or why your request cannot be fulfilled.
Personal data security
We have taken appropriate technical and organizational measures to protect your personal data against loss, misuse, unauthorized access or unauthorized disclosure. We ensure that only authorized persons have access to personal data and that all data manipulation is properly secured. We use modern secure servers and transmission encryption (our websites use the HTTPS protocol), which reduces the risk of unauthorized interception of information during communication between you and our website.
We process all personal data in electronic form in secure systems. Data in paper form (if we process it) is stored in locked areas with limited access. We also try to minimize the risk of leakage or misuse of personal data with appropriate internal policies - we train employees on the importance of data protection and oblige them to confidentiality.
In the event that, despite all measures, a breach of personal data security occurs that would pose a high risk to you, we undertake to inform you of this fact without undue delay, along with a description of the nature of the incident and any recommendations for your protection.
